Chilean Family Lawyer for Clients Living Abroad
Last updated: October 7, 2026
If you live outside Chile and need to handle a family matter in Chile (child support, visitation or custody, divorce, paternity, or permission to travel with your children), you can do much of it from where you are. Rusconi Abogado works with clients abroad by video call, wherever they live. Chilean law lets the mandatory prior mediation be held by videoconference when both parties agree.
What you can handle from abroad
- Mediation by video call. Mandatory prior mediation can be held by videoconference if both parties agree and the mediator has the technology (Law 19.968, arts. 103 and 109 bis). How it works for visitation.
- Permission to take your children out of Chile. Article 49 of the Minors Law sets who must authorize it and how (a notarized permit, or the judge if it is refused without plausible reason). Details and international child return.
- Collecting child support from another country. Chile is a party to the 1956 New York Convention, which works with the other States that are parties. See which countries and how.
- Power of attorney from abroad. How to grant it before a foreign notary or a Chilean consul.
- Access rights under the 1980 Hague Convention, where the Convention is in force between Chile and your country, through the Central Authority or directly in the Chilean courts.
How we work
We start with a 45-minute initial consultation by video call, where we assess your situation and explain your options, realistic timelines and estimated costs before you decide anything (consultation fee: CLP 50,000). We work Monday to Friday, 9:00 to 18:00 Chile time; you can write at any time through the contact form or the virtual assistant on this page, and we will reply on the next working day.
